Court rules in favour of masquerade, orders release, compensation

A court in Uyo has ruled that the arrest and detention of Effiong, a masquerade performer, by the Akwa Ibom State Police Command was a violation of his fundamental human rights.

Effiong had been detained for allegedly disturbing public peace during a traditional masquerade outing.

The court declared that his “arrest and detention amounted to a violation of his fundamental human rights, including his freedom of worship as guaranteed by the Nigerian Constitution.”

It ordered his immediate and unconditional release and directed the Akwa Ibom State Government to pay damages for the infringement.

Highlighting the importance of cultural rights, the court emphasised that “traditional religious practices are protected under Nigerian law and that authorities must respect the cultural expressions of indigenous communities.”
